These Terms and Conditions govern the use of services provided by 55Rock Pty Ltd (“we,” “our,” or “us”), including the hiring of excavators and equipment, and the financing options available. By accessing our website and using our services, you agree to these terms. Please read them carefully.
- "Customer" refers to the individual or business entity hiring equipment from [Your Company Name].
"Equipment" refers to any excavators or other machinery rented from us.
"Finance Plan" refers to the zero-interest finance option provided by us for customers seeking flexible payment arrangements.
To hire equipment from 55Rock P/L:
- You must be 18 years or older and possess a valid form of identification.
You must provide accurate and complete information during the registration and rental process.
Business entities must provide valid business credentials, including but not limited to an ABN (Australian Business Number) if applicable.
Booking: All bookings must be made through our website or by contacting our customer service team. Availability of equipment is subject to prior bookings and current inventory.
Deposit: A deposit may be required to secure the rental. This deposit will be refundable upon the return of the equipment in good working condition.
Inspection: Customers are encouraged to inspect the equipment upon delivery or pickup. By accepting the equipment, you acknowledge that it is in good working order.
Duration: The rental period begins once the equipment is delivered or picked up and ends when it is returned. Extensions must be arranged in advance and may incur additional fees.
Late Returns: Failure to return the equipment on the agreed-upon date without prior notification will result in additional charges as per our pricing schedule.
- Maintenance: Customers are responsible for maintaining the equipment during the rental period, ensuring it remains in good working condition. Misuse or negligent operation may result in additional fees for repairs or replacement.
Damage: Any damage caused to the equipment during the rental period is the responsibility of the customer. The customer will be liable for the costs of repairs or replacement if the equipment is damaged or lost.
Insurance: Customers are required to have insurance covering any potential damage or loss during the hire period. Proof of insurance may be requested at the time of hire.
- Eligibility: Customers opting for the zero-interest finance plan must provide valid credit information and may be subject to a credit check.
Repayment Terms: The finance plan allows customers to spread payments over an agreed period. The total cost of hire will be divided into installments, with no interest charges. Failure to meet the repayment deadlines may result in penalties or the withdrawal of the finance plan
Late Payments: Late or missed payments under the finance plan will incur additional fees. Persistent non-payment may lead to legal action to recover the outstanding balance.
Termination of Finance Agreement: We reserve the right to terminate the finance agreement if the customer fails to meet payment obligations or provides false information during the application process.
- Rental Rates: Our rental rates are subject to change without notice. However, confirmed bookings will be honored at the price at the time of the booking.
Payment: Payment must be made in full before or at the time of equipment delivery unless a finance plan has been arranged. We accept major credit cards, bank transfers, and other approved payment methods.
Taxes: All prices quoted on our website are exclusive of applicable taxes, which will be added during the checkout process.
- Delivery: We provide delivery services for all hired equipment at an additional cost. Delivery times will be confirmed during the booking process.
Pickup: Customers may also arrange to pick up the equipment from our designated location. The customer is responsible for the safe transport of the equipment and compliance with local transportation laws.
Return Condition: Equipment must be returned in the same condition in which it was rented. If additional cleaning or maintenance is required upon return, the customer will be charged accordingly.
- Limitation of Liability: 55Rock P/L will not be held liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the rented equipment. Our liability is limited to the total amount paid for the rental.
Indemnification: The customer agrees to indemnify and hold 55Rock P/L harmless from any claims, damages, losses, or liabilities arising out of the customer’s use or misuse of the equipment.
- Cancellations: Cancellations must be made at least 3 days before the scheduled rental period to receive a full refund. Cancellations made less than 3 days prior may incur a cancellation fee.
Refunds: Refunds will be processed within 14 business days after the cancellation is confirmed. Deposits will only be refunded if the equipment is returned in good condition and on time.
No-Show: If the customer does not show up to pick up the equipment or is unavailable during the scheduled delivery time without prior notice, no refund will be issued.
- Compliance with Laws: Customers must comply with all applicable local, state, and federal laws, including occupational health and safety regulations, while using our equipment.
Qualified Operators: The customer must ensure that the equipment is operated by qualified personnel with sufficient training and experience to use the equipment safely.
We will not be held liable for any failure or delay in fulfilling a rental or finance agreement due to causes beyond our control, such as natural disasters, strikes, or governmental restrictions.
We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. We recommend that you review this page regularly to stay informed about any updates.
These Terms and Conditions are governed by and construed in accordance with the laws of Vivtoria, Australia, and any disputes arising from these terms will be subject to exclusive jurisdiction of the courts in Victoria Australia.
